These Terms & Conditions ("Terms") govern your access to and use of the lnkys platform, including our URL shortening, link management, analytics, API, custom domain, QR code, and other related SaaS services. By creating an account, purchasing a subscription, or using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms. 1. Eligibility You must be legally capable of entering into a binding agreement under applicable law to use the Service. If you use the Service on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to accept these Terms on its behalf. 2. Our Services The lnkys Platform may provide features including: URL shortening. Link management. Click and traffic analytics. UTM campaign management. QR code generation. Custom domains. API access. Link expiration. Link editing and redirection. Team and user management. Subscription-based features. Other features introduced from time to time. We reserve the right to add, modify, suspend, or discontinue features of the Service at any time. 3. Account Registration Certain features of the Service may require you to create an account. You agree to: Provide accurate and complete information. Keep your account information accurate and up to date. Maintain the confidentiality of your login credentials. Not share your account credentials with unauthorized persons. Notify us promptly of any unauthorized access to your account. You are responsible for all activities conducted through your account. 4. Acceptable Use You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. You must not use the Service to create, distribute, or promote shortened URLs that: Facilitate phishing or credential theft. Distribute malware, viruses, ransomware, or other malicious software. Facilitate fraud, scams, or deceptive activities. Impersonate individuals, companies, government entities, or organizations. Promote or facilitate illegal activities. Distribute spam or unsolicited communications. Facilitate financial fraud. Violate intellectual property rights. Violate privacy or data protection laws. Contain illegal, harmful, or abusive content. Attempt to bypass or interfere with security mechanisms. Attempt unauthorized access to systems or networks. Abuse our API, infrastructure, or resources. Generate excessive or abusive automated traffic. Circumvent subscription limits or usage restrictions. Be used to conduct attacks against third parties. We may suspend or disable any URL, domain, account, or other resource that violates these requirements. 5. Phishing, Malware, and Abuse We maintain a strict policy against malicious or abusive URLs. If we determine, or reasonably suspect, that a shortened URL is associated with phishing, malware, fraud, credential harvesting, spam, scam campaigns, malicious redirects, or similar abusive activity, we may immediately disable the URL and/or associated account without prior notice. Where appropriate and permitted by law, we may cooperate with law enforcement agencies, hosting providers, security organizations, domain registrars, or other relevant parties. 6. User-Generated Content You remain responsible for the URLs, destination websites, descriptions, UTM parameters, campaigns, and other content you submit through the Platform. You represent and warrant that you have all necessary rights and permissions to use and distribute such content. We do not claim ownership of your content. However, you grant us the limited rights necessary to host, process, transmit, analyze, and display your content solely for the purpose of providing, maintaining, securing, and improving the Service. 7. Custom Domains If the Platform supports custom domains, you are responsible for: Owning or having authorization to use the domain. Maintaining the domain registration. Configuring DNS records correctly. Ensuring the domain is not used for prohibited activities. Maintaining compliance with applicable laws and regulations. We may suspend or disable a custom domain if it is associated with abuse, phishing, malware, fraud, or other prohibited activities. We are not responsible for the loss, expiration, suspension, or transfer of a domain registered through a third-party registrar. 8. UTM Parameters The Service may allow you to create and manage UTM parameters, including utm_source, utm_medium, utm_campaign, utm_term, and utm_content. You are responsible for ensuring that your use of UTM parameters, tracking technologies, and related data complies with all applicable privacy and data protection requirements. 9. Analytics Depending on your subscription plan, we may provide analytics including: Number of clicks. Date and time of clicks. Referrer information. Device type. Browser information. Operating system. Approximate geographic information. Campaign information. Other aggregated or technical information. Analytics may be affected by browser settings, privacy technologies, ad blockers, network configurations, and other technical limitations. Accordingly, analytics data may not always represent the exact number of human visitors. 10. API Usage If API access is available, you agree to use the API in accordance with the applicable API documentation, usage limits, and technical requirements. You must not: Exceed applicable rate limits. Abuse API endpoints. Attempt to bypass API restrictions. Use automated requests to attack, overload, or disrupt the Platform. Publicly disclose or share API credentials. Use API credentials belonging to another user. We may throttle, restrict, suspend, or terminate API access when reasonably necessary to protect the Platform and its users. 11. Subscription Plans Certain features require a paid subscription. Subscription plans may differ in terms of: Number of shortened URLs. Number of clicks. Analytics retention. Number of custom domains. API access and limits. Number of team members. Storage. Other features and usage limits. We reserve the right to modify available plans, pricing, features, and usage limits. 12. Billing and Automatic Renewal Paid subscriptions may be billed monthly, annually, or according to the billing period selected at the time of purchase. Where automatic renewal applies, your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. You authorize our payment provider to charge the applicable subscription fee using your selected payment method. 13. Prices and Taxes Prices displayed on the Platform will be presented in the applicable currency and may be subject to applicable taxes, including VAT, where required by applicable law. Where applicable, taxes may either be added to or included in the displayed price, depending on the pricing configuration and applicable legal requirements. We may change our prices from time to time. Price changes will generally apply to future billing periods and will not affect a billing period that has already been paid for, unless otherwise required by law. 14. Refund Policy Unless otherwise stated in our applicable Refund & Return Policy or required by applicable law, subscription fees are generally non-refundable after a billing period has started. If you cancel your subscription, you may continue to use paid features until the end of your current billing period, unless otherwise stated. Refunds may be considered in exceptional circumstances, including duplicate payments, technical billing errors, unauthorized charges, or other circumstances determined by us or required by applicable law. Any refund will be processed in accordance with our Refund & Return Policy and the applicable payment provider's procedures. 15. Free Trials If we offer a free trial, the trial period and applicable conditions will be specified at the time of registration. Certain features may be limited during the trial period, and we may require valid payment information. Unless otherwise stated, a free trial may automatically convert to a paid subscription when the trial period ends. You are responsible for cancelling before the end of the trial period if you do not wish to continue with the paid subscription. 16. Cancellation You may cancel your subscription through your account or by contacting our support team, depending on the cancellation methods available on the Platform. Cancellation does not automatically entitle you to a refund for the current billing period unless otherwise required by applicable law or our Refund & Return Policy. 17. Suspension and Termination We may suspend or terminate your account if: You violate these Terms. You use the Service for illegal activities. Your account is involved in phishing, malware, fraud, spam, or other abuse. You attempt to compromise the security of the Platform. You abuse the API or Platform infrastructure. You fail to pay applicable fees. Your activity creates a security, legal, or operational risk. We may also disable individual URLs, domains, API credentials, or other Platform resources when necessary. 18. Effect of Termination Upon termination: Your access to the Service may be disabled. Your shortened URLs may stop functioning. Your API credentials may be revoked. Your subscription benefits may end. Your data may be deleted in accordance with our applicable data retention policies. You are responsible for maintaining backups of any information you require. 19. Service Availability We aim to provide a reliable and secure Service. However, we do not guarantee that the Service will always be available, uninterrupted, completely error-free, immune from security incidents, or capable of providing completely accurate analytics. The Service may be temporarily unavailable due to maintenance, upgrades, infrastructure problems, security incidents, or circumstances beyond our reasonable control. 20. Third-Party Services The Platform may integrate with third-party services, including payment providers, cloud hosting providers, analytics services, email providers, domain registrars, and security services. Your use of third-party services may be subject to their own terms and privacy policies. We are not responsible for the availability, security, or operation of third-party services. 21. Intellectual Property All intellectual property rights in the Platform, including software, source code, UI/UX, branding, logos, platform design, documentation, and features, belong to lnkys or its licensors, unless otherwise stated. You may not copy, reproduce, modify, distribute, reverse engineer, or create derivative works from the Platform except where expressly permitted by applicable law. 22. Privacy Your use of the Service is also subject to our Privacy Policy. Our Privacy Policy explains how we collect, use, process, store, and protect personal information. 23. Data Protection If your use of the Service involves the processing of personal data, you are responsible for ensuring that your processing activities comply with applicable privacy and data protection laws. Where applicable, additional data-processing terms may apply. 24. Security We implement reasonable technical and organizational measures designed to protect the Platform and user information. However, no internet-based service can guarantee absolute security. You are responsible for maintaining the security of your account credentials, API keys, passwords, and other authentication information. 25. Limitation of Liability To the maximum extent permitted by applicable law, lnkys shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, business, data, or business interruption arising from or related to your use of the Service. We shall not be responsible for losses resulting from unavailable shortened URLs, third-party websites or services, or circumstances beyond our reasonable control. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law. 26. Indemnification To the extent permitted by applicable law, you agree to indemnify and hold lnkys and its affiliates, officers, employees, and service providers harmless from claims, damages, losses, liabilities, and expenses arising from: Your violation of these Terms. Your misuse of the Service. Your content. Your violation of third-party rights. Your violation of applicable laws or regulations. 27. Changes to the Service We may modify, improve, replace, or discontinue features of the Service from time to time. Where material changes affect paid subscriptions, we may provide reasonable notice where appropriate. 28. Changes to These Terms We may update these Terms from time to time. The latest version will be published on this page, and the Last Updated date will indicate when these Terms were most recently updated. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms, to the extent permitted by applicable law. 29. Governing Law These Terms shall be governed by and interpreted in accordance with the laws applicable to lnkys and the applicable jurisdiction of its legal entity, except where otherwise required by applicable law. Any disputes shall be subject to the jurisdiction of the competent courts of the applicable jurisdiction, unless otherwise required by applicable law
